Booking Conditions

These Booking Conditions together with the Legal Notice and the Privacy Policy propposed by L'Hort de Sant Cebrià to its customers, regulate the reservationinthe establishment through the website www.hortdesantcebria.com (hereinafter, the "Web").

These General Conditions have been prepared in accordance with the provisions of Law 34/2002, on Services of the Information Society and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, which approves the Revised Text of the General Law on the Defense of Consumers and Users and other complementary laws and Law 7/1996 on the Regulation of Retail Trade.

It is important that the Guests read and understand each of these clauses. In the event that the Guests do not agree with any of the clauses of the Booking Conditions, They must not advance in the reservation process as indicated below. The confirmation of the reservation by the Guests expressly implies the knowledge and acceptance of these Reservation Conditions as part of the formalization of the contract.


1. GENERAL CHARACTERISTICS OF THE PRODUCTS

The Guests can make reservations through the L’hort de Sant Cebrià’ website. All guests requesting accommodation must be over 12 years old.

The services characteristics and the services contracted are those set out in these Reservation Conditions, on the website and in the e-mails sent by L'Hort de Sant Cebrià to the Guests confirming the reservation and payment.


2. PROCEDURE FOR RESERVATION PROCESSING

L'hort de Sant Cebrià makes available to the Guests the means set out below so that he can make his reservations:

• Online booking: Connected to the website www.hortdesantcebria.com, the Guests have a calendar in which they must indicate the dates they wish to book. When They has chosen one of the available rooms, they must complete the electronic form with the requested data (name, surname, telephone number and email address). Form fields marked with an asterisk (*) are mandatory, the others are optional.

At the end of the form, the Guests have access to a summary of the reservation with the reference, the unit price, the quantities and the total price. If they agree with the information provided, they should press the "Make Payment" button.

Next, the Guests must indicate the data of their credit card, being redirected to a secure payment gateway (online booking and payment are made through the external platform Avaibook).

Once the payment has been confirmed, the Guests receive an email with the receipt of the payment and a printable document of the booking confirmation.

• Booking by email; the Clients can request information about availability and prices through the contact form that appears on the website of L'hort de Sant Cebrià indicating their name, surname, telephone and email, dates and number of guests. The establishment will reply by email indicating the available rooms with their prices, along with the conditions of reservation and cancellation. This email also requests a credit card number to charge the amount of the deposit that is requested to formalize the reservation.

To confirm the reservation, the clients must send a new email indicating the desired room and the requested credit card details.

• Reservation by phone: the Clients can call the contact telephones indicated on the website (972 55 0067 or 609 425 655) and request the desired information. L'hort de Sant Cebrià will inform them about everything they need and also about the conditions of reservation and cancellation. Once the clients confirm their intention to book, their data will be noted (name, surname, telephone number, email address, number of guests who will stay, the room and dates of stay they wishes to book, the complementary services that they want to book and a credit card number where the amount of the reservation deposit will be charged).


Whether the reservation is made by email or by phone, L'hort de Sant Cebrià send a confirmation email once the payment of the deposit has been received. This email includes all the details of the reservation and the cancellation conditions.

In order to correct errors after the booking formalization, the clients must contact L'hort de Sant Cebrià by sending an email to info@hortdesantcebria.com.


3. PRICE AND PAYMENT METHOD

The cost of the reservation is that indicated in the email sent to the Guests. All prices include the VAT applicable in Spain and the cost of other taxes, fees or exceptional payments will be reported.

The price of the reservation does not include, in any case, the tourist tax. This tax applies to all reservations and its cost is € 0.60 per person and night. It is only applicable to adults and children over 16 years of age and the amount must be paid by the Guests on the day of arrival.

To confirm the reservations made by email or telephone, L’hort de Sant Cebrià asks the Guests their VISA or Mastercard credit card details in order to charge the deposit requested.

To make the reservation online, the payment of the deposit is made through the Avaibook platform. This payment is protected with a secure electronic commerce system. L’Hort de Sant Cebrià does not have access to the Guests card details.


4. CHECK-IN AND CHECK-OUT HOURS

The Guests are able to access the establishment between 14:00 and 21:00 hours on the arrival day and must leave before 12:00 hours on the departure day.


5. DUTIES OF CUSTOMERS

The Guests shall:

• Pay the price of tourist services in the place, form and time agreed.

• Respect the regulations of use or internal regime, provided that they are not contrary to the provisions of the Law and the provisions that develop it, as well as the general rules of coexistence and hygiene.

• Respect the establishment, facilities, goods and services that are made available to them.

• Respect the environmental, cultural or other values of the tourist resources that they use or visit.

• Prove their identity at the check-in time by a document that proves it sufficiently. This document will be returned immediately to the guests.


The establishment will keep a record of the guests staying and will communicate to the General Directorate of the Police the information related to these people, in accordance with the applicable citizen security regulations.


6. RIGHT OF WITHDRAWAL – BOOkING CANCELLATION

The Guests have the right to cancel their reservation. To do so, they must communicate this by sending a written statement by email to info@hortdesantcebria.com. They can use the cancellation form indicated at the end of these Booking Conditions, if they wish.

No penalty will be applied to them as long as they cancel until 15 days before the booked arrival date.

Cancellation made between 14 and 7 days prior to the arrival date results in a penalty of 30% of the total cost of the stay.

In the case of a cancellation made 6 or less days before the arrival date, the Guests must pay the full cost of the reservation.

When the cancellation occurs due to force majeure, duly accredited, the establishment will can decide whether or not to apply some type of penalty.

L'hort de Sant Cebrià have a maximum period of 14 calendar days from the withdrawal to return to the Guests the sums received.


7. WAIVER OF STAY

If the Guets leave the accommodation before the date provided for in their reservation, L'hort de Sant Cebrià can request full payment fo rthe services that were contracted, unless an agreement is reached between the parties.


8. REIMBURSEMENT OF AMOUNTS PAID

When, in accordance with these Booking Conditions, the Guests are entitled to a refund of amounts paid, the refund will be made by L'hort de Sant Cebrià using the credit card provided or by bank order. If the payment was made through the Avaibook, the refund will be made through this platform, on the same credit card provided when booking.


9. GENERAL INFORMATION

The contract and the documents related to the reservation can be written in Spanish, Catalan, English or French.

L’hort de Sant Cebrià will keep a copy of the electronic booking confirmation. This document will be available to the Guests, who may request a copy by sending an e-mail to info@hortdesantcebria.com.


10. CUSTOMER SERVICE

The Customer may address any doubts, complaints or grievances to L’hort de Sant Cebrià by post, e-mail or through the contact telephone numbers displayed on the website. The Sant Cebrià orchard is committed to offering a response to the customer as soon as possible.


11. APPLICABLE LAW AND JURISDICTION

These Booking Conditions are governed by Spanish law and the parties will submit to the courts and tribunals of the consumer's domicile for the resolution of disputes arising from this contract.
